It is increasingly necessary, given the Charity Commission's regulatory role, to ensure that your charity is being run properly and is acting in accordance with its constitution.
A charity, once established, can continue indefinitely but it is likely that circumstances will change over its lifetime. We operate a specialist Charity Team that offers a review service to existing charities, to ensure that their activities remain within the objects (as outlined In their constitution), or to confirm whether the charity can undertake proposed activities.
Where necessary, we will deal with alterations to a charity's constitution, drafting all the necessary documentation and advising on how the changes should be applied.
In appropriate cases, we will advise on the complete restructuring of a charity or the adoption of a new legal form to meet changed requirements.
We can also advise on issues surrounding the merger of two or more charities, where appropriate, working closely with our company commercial and employment teams to ensure that all legal formalities, not just those relating to charity law, are complied with.
The ultimate responsibility for control and management of a charity rests with its trustees, who are often referred to as the 'governors', 'directors' or 'committee members'. We recognise that the responsibilities which they face are significant and that, in discharging their duties, they will need clear and constructive advice on a wide variety of issues. We routinely advise on issues such as good governance, administration, and trustee liabilities, benefits and remuneration.
